goList Contest: Official Rules


VOID IN QUEBEC (DUE TO LEGAL REASONS) AND WHERE PROHIBITED.
  1. HOW TO ENTER: You may enter the goList Contest ("Contest") by submitting a goList on www.tripadvisor.com between 12:00 a.m. Eastern Time, U.S. ("ET") on May 5, 2008, and 11:59 p.m. ET on August 3, 2008 (the "Promotion Period"). All submissions must comply with the TripAdvisor® content submission guidelines and are subject to the TripAdvisor Terms of Use, both of which are available at www.tripadvisor.com (for the submission guidelines, visit: www.tripadvisor.com/pages/goLists_guidelines.html). Without limiting the foregoing, by submitting a goList, you grant TripAdvisor the right to immediately post it, along with your name and hometown and state or province, on www.tripadvisor.com and in any other TripAdvisor promotional materials without compensation. By submitting a goList, you fully and unconditionally agree to and accept these Official Rules and the decisions of TripAdvisor, which are final and binding. You may enter as often as you like.
  2. SELECTION OF POTENTIAL WINNERS: On or around August 6, 2008, TripAdvisor will select one (1) potential grand prize winner from among all eligible goLists received during the Promotion Period, based on: (1) the quality of the writing of the submitted goList; (2) the informational value of the submitted goList; and (3) the uniqueness of the submitted goList's topic. The selection criteria will be weighted equally. In the event of a tie, the submission with the higher score for uniqueness will be the potential winner.
  3. PRIZE: The Grand Prize Winner will receive an America Express Gift Card worth $2500.00, along with thirty-six (36) California Almond travel tins worth $89.28. TripAdvisor reserves the right to substitute a prize or prize component of comparable or greater value.  No cash or other substitution or transfer of prize permitted. All costs associated with prize receipt and use, including, without limitation, taxes, are the responsibility solely of the winner. If the Grand Prize winner is a resident of the U.S., TripAdvisor will issue an IRS Form 1099 for tax reporting purposes.
  4. ELIGIBILITY: The Contest is open only to individual legal residents of the fifty (50) United States, the District of Columbia and Canada (except Quebec), who have reached the age of majority in their respective jurisdictions as of the date of entry. Void in Quebec (due to legal reasons) and where prohibited. Employees (and their immediate families and members of the same household) of TripAdvisor, The Almond Board of California, each of their respective related companies, agents and promotion agencies are not eligible. "Immediate families" means parents, spouses, siblings and children. Submissions received by any automated means, including but not limited to contest entry services, will be disqualified.
  5. REQUIREMENTS OF POTENTIAL WINNER: The potential winner will be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release, in order to receive the prize. If the potential winner is a resident of Canada, he/she will be required to correctly answer, unaided, a timed skill-testing question in order to receive the prize. Prize may be awarded to alternate winner if signed affidavit/release is not returned within fourteen (14) days after e-mailing to potential winner, if prize notification e-mail, affidavit or prize is undeliverable, if potential winner does not respond to notification e-mail within seven (7) days after the date of the e-mail, or if TripAdvisor determines that the potential winner is ineligible. Except where prohibited, by accepting a prize, winner agrees to TripAdvisor's use of his/her name, hometown and state or province, likeness, and/or prize information for promotional purposes in any media, worldwide, without additional compensation.
  6. RELEASE: By participating in the Contest, entrant agrees to release and hold harmless TripAdvisor, The Almond Board of California, each of their respective related companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize.
  7. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (a) any inaccurate information, whether caused by participants or printing errors; (b) unauthorized human intervention in any part of the Contest; (c) technical failures of any kind; (d) technical or human error which may occur in the administration of the Contest or the processing of submissions; (e) lost, delayed, misdirected or undeliverable mail or e-mail; or (f) any injury or damage to persons or property including, but not limited to, death, which may be caused, directly or indirectly, in whole or in part, from participation in the Contest or receipt or use of any prize.
  8. DISPUTES: Except where prohibited, participant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Commonwealth of Massachusetts, U.S.A; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees; and (c) participant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. All issues and questions concerning these Official Rules and the Contest shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, U.S.A., without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any other jurisdiction.
  9. GENERAL: The Contest is subject to all applicable federal, state, provincial and local laws and regulations. TripAdvisor reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Contest should any virus, bug, technical failures, unauthorized human intervention or other causes beyond TripAdvisor's reasonable control corrupt or affect the administration, security, fairness or proper conduct of the Contest. TripAdvisor reserves the right, at its sole discretion, to disqualify any participant if his or her conduct affects the integrity of the Contest. TripAdvisor's failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
